Booking Terms & Conditions

Your Booking.

The party leader who completes the booking enquiry form must be at least 18 years of age at the time of booking.

Your booking is made as a consumer and you agree that no liability can be accepted by the owners of Greenacres Stud for any expenses, costs, losses, claims or other sums of any description which relate to any business however suffered or incurred by you. When Greenacres Stud issues a written confirmation to you , this signifies that Greenacres Stud has entered into a contract with you which is subject to these conditions. Greenacres Stud has the right to refuse any booking prior to the issue of your written confirmation and if Greenacres Stud does this , will tell you in writing promptly and refund any money you have paid to us.

All prices are inclusive of  V.A.T. at a rate of seventeen and one half percent which will not be varied for the duration  of this contract.

You and all members of your party agree to keep the property clean and tidy and leave the property in a similar condition to that which you found upon your arrival . You are responsible to Greenacres Stud for the actual costs of any breakages or damage in or to the property along with any additional costs that may result , which are caused by you and / or any members of your party and that Greenacres Stud can require payment from you to cover any such costs.

Greenacres Stud is entitled and has absolute discretion to refuse to hand over to you or repossess the property  ( which includes fixtures and fittings , furnishings and decorations if  Greenacres Stud reasonably believes that any damage is being caused or likely to be caused by either you or  members of your party. In these circumstances no refund of any monies you have paid in respect of your booking will be made as you will be deemed to have cancelled this contract by way of your actions .

You must not allow more than 2 adults to occupy  the self catering apartment. For the sake of clarification adult in this contract means any person over the age of  2 years.

You must not allow more than one animal ( whether horse or pony ) to occupy each individual stable , save only by  the express agreement of Greenacres Stud . Exceptions will be granted to Mares with a Foal at Foot  ,  Miniatures and Shetland Ponies.

Cancellations.

We do not expect to make any changes or to cancel this contract , but if we do , Greenacres Stud will compensate you £20 for each booking in addition to a full refund of money.

If you should choose to cancel this contract before 21  days of the day of your booked arrival , then you agree to forfeit all deposits paid to Greenacres Stud.  Failure to remit any money due to Greenacres Stud or  it not arriving  within 21 days before the day of your booked arrival , will also be treated as a cancellation of this contract .

Cancellations between  14 days and 21 days before the day of your booked arrival , Greenacres Stud will refund 40% of the total money paid to us , minus your deposit.

Cancellations between  7 days and 14 days before the day of your booked arrival , Greenacres Stud will refund 30% of the total money paid to us , minus your deposit.

Cancellations less than 7 days before the day of your booked arrival , then Greenacres Stud will make no refund.

( For  the sake of clarity , booked days are from Midnight to Midnight.)

Should you arrive later than the day of your booked arrival , or depart without reasonable due cause earlier than your booked departure day , then no money will be returned to you  from Greenacres Stud  to compensate you for this lost time.

Circumstances beyond the control of Greenacres Stud  ( Force Majeure)

Except where otherwise expressly stated in these conditions , Greenacres Stud shall not be liable for any changes , cancellations , effect upon your booking , loss or damage suffered by you or any failure by Greenacres Stud to perform or properly perform any of their respective obligations to you which is due to any event (s) or circumstance ( s) beyond the reasonable control of Greenacres Stud , ( referred to as " force majeure " in these Conditions ) By way of example , force majeure includes fire , flood , exceptional weather conditions , epidemics , destruction or damage of the property by any cause , ( other than negligence by Greenacres Stud ) and all similar situations . In appropriate cases ( for example where your booking has to be cancelled before departure ) Greenacres Stud will however refund all monies paid to us for your booking .No compensation , expenses , costs or other sums of any description will be payable in such circumstances.

Liability.

Greenacres Stud shall have no liability for any death or personal injury nor any liability for death or injury to livestock whilst upon our premises unless this results from the proven negligence of Greenacres Stud or any of its employees ( provided they were at the time acting in the course of their employment ) .You must take all necessary steps to safeguard your personal property. No liability is accepted by Greenacres Stud in respect of damage to , or loss of such personal property except where the loss or damage is proven to be caused by the negligence of Greenacres Stud or that of any employee of Greenacres Stud , ( provided they were at the time acting in the course of their employment ) .

Arrivals and Departures.

You can arrive at Greenacres Stud after 3pm on the start date. You must leave at 10 am on the last day .If your arrival will be delayed beyond 9 pm you must contact the person whose details you will find given on the location guide so that alternate arrangements may be made. If you fail to do so , you may not be able to gain access to the property and no refunds will be given for any lost time.

Pets

If you bring a pet with you , it is not allowed on beds nor chairs. Pets should not be left unattended in the property and dogs should be kept upon a lead within the boundaries of the property.

Customers with allergies should be aware that Greenacres Stud cannot accept any liability for any suffering which may occur as a result of animals having been previously present.

You are responsible for cleaning up after your pet at all times.

Complaints.           

Every effort has been made to ensure that you have an enjoyable stay at Greenacres Stud. If however  , you have cause for complaint , Greenacres Stud are anxious that remedial action is taken as soon as possible. It is essential that you contact the person named upon your location guide immediately if any problem arises so that it can be speedily resolved. if you are still not satisfied we ask that you put your complaint in writing for the attention of the proprietors of Greenacres Stud who will investigate any complaint further.

Data protection Act 1998.  

Greenacres Stud is Licensed under the above act. For the purpose of the act Greenacres Stud is the sole controller of all personal data provided to it. No personal details given to Greenacres Stud will be given to a third party without your written consent. All details you give to Greenacres Stud at any time will be kept , but only names , contact details and any booking references will only be used for our internal administrative purposes.

Law.  

The contract between you and Greenacres Stud is subject to English Law and no other and is formed in Coton in the Elms  , South Derbyshire  England. It is agreed that any dispute you may have with Greenacres Stud will be dealt with by the Courts of England and Wales , only unless you live in Scotland or Northern Ireland ,  in which case proceedings may be brought in the courts of those countries.

Your rights.

Your statutory rights are not affected by anything contained within this contract.

Greenacres Stud is a Trading name of Kenyoncrest Ltd. a Company  registered in England and Wales.
